Documenting Property Damage in Florida Insurance Claims

When a hurricane, flood, fire, or other disaster strikes your Sarasota home or business, the steps you take in the first 48 hours can make or break your insurance claim. Create a Written Inventory of Every Loss

Florida law requires insurers to act in good faith when adjusting claims, but that obligation only goes as far as the documentation you provide. A detailed written inventory forces the adjuster to account for each item rather than offering a lump-sum settlement that inevitably falls short.

Your inventory should include:

  • Item description (brand, model, size, color)
  • Approximate age and original purchase price
  • Estimated replacement cost at current market prices
  • Any receipts, credit card statements, or photos that prove ownership
  • Serial numbers for electronics, appliances, and tools

For structural damage, note every affected component separately — roof decking, shingles, fascia, soffits, drywall, insulation, flooring, windows, and doors should each have their own line item. Understand Florida's Claim Filing Deadlines

Florida Statute §627.70132 imposes strict deadlines on property damage claims. For most residential property claims, you have two years from the date of loss to file an initial claim, and three years for hurricane or windstorm claims under many policies. Supplemental claims — for damage discovered after the initial claim is filed — must generally be submitted within three years of the date of loss.

These deadlines are not negotiable. Missing them can permanently extinguish your right to recovery regardless of how well-documented your damage is. Sarasota homeowners who delay filing because they hope the insurer will handle things fairly often find themselves time-barred when the initial settlement proves inadequate.

After your insurer receives notice of the claim, Florida law requires them to acknowledge receipt within 14 days, begin an investigation promptly, and make a coverage decision within 90 days.
